How To Change An Existing Employment Contract

If you want to change an employee’s terms and conditions of employment, you will need to get their agreement first. Otherwise, the employee may be entitled to sue for breach of contract, or resign and claim constructive dismissal. You must tell the employee in writing about any changes no later than one month after you have made the change. Do changes have to be in writing? Agreed changes don’t necessarily have to be in writing. However if they alter the terms in your ‘written statement of employment particulars’,

Your employer must give you another written statement showing what has changed within a month of the change. Employee Enforcement of the Right Employees have certain rights. These rights are enforceable by law: The right of fair treatment regardless of age, race, religion, gender, disabilities, or sexual preferences The right to equal treatment, also with regard to wages The right no be dismissed without proper cause and the correct procedures The right not to get fired for giving birth to a child Employees also have the right to a proper written notice time for termination of their work agreement in relation to the period employed Employees have the right for compensation when they are retrenched Safe workplace Terminating the Employment ContractBoth employer and employee can terminate the employment contract according to the terms contained within it. Either side can make a complaint against the other.

Breach-of-Contract Claims Both employers and employees can be in breach of a contract of employment. A breach of contract happens when either employee or your employer breaks one of the terms. If an employee continues to work under these changes without objecting, they may be regarded as having accepted the changes. Not all the terms of a contract are written down. A breach may be of a verbally agreed term, a written term, or an ‘implied’ term of a contract. Employer would normally use a county court for a breach of contract claim. The only way an employer would be able to make an application to an Employment Tribunal is in response to a breach of contract claim that an employee has made. The most common breaches of contract by an employee are when they quit without giving (or working) proper notice, or when they go to work for a competitor when their contract doesn’t allow it. Caribbean Film Production Service Industry

After Hollywood came Bollywood, and with it the dream of many developing countries to benefit from the big film business and its many dollars rolling into the country. One of those regions is the Caribbean, which has all those beautiful different Islands with diverse scenery and with the advantage of being closely located in a very small territory. Apart from that it is in close range to international airports in the US, Canada and Europe. Those Caribbean islands that used to be former English, Dutch, and Spanish colonies are mostly independent countries nowadays and they have fantastic scenery and naturally beautiful landscapes. Those may very well serve as the location background for movies and television shoots. This can turn into a good second income, generated out of the country’s natural resources along with the tourism industry.

Jamaica, Cuba, and Barbados were among the first ones to make efforts to attract international film and television producers to the Caribbean Islands for their movie productions and TV commercial shoots. That is apart from the French Islands St. Martin, St. Barts, Guadeloupe and Martinique which are still part of France and had always been used for French television and film productions. For the other islands, it started on a smaller scheme – the beautiful beaches, tropical gardens, romantic fishing villages and plantation houses along with luxury mansions were first accepted as backdrop by the fashion magazines and catalogers for their fashion photo shoots as a photographic production needs a less developed infra structure than a film shoot.

Even though the Caribbean region is geographically closer to the United States, but it was mostly Europeans who believed in the possibility to turn the Caribbean region into a mayor playground for international film locations. Along with many government agencies, they were the first ones to put money and efforts into the development of this industry.

Today one of the most successful companies providing locations and film, video and photo production service in the Caribbean region is “The Caribbean Production Service Company”, who had started in Barbados in 1998.

After having visited several Caribbean Islands, they had decided that Barbados offers the best possibilities for the start of this kind of support service for the film industry in the region. The main subject was to get Barbadians to open their doors to those foreign film teams and to convince government agencies to be supportive to the new venture. Now in order to save foreign production companies money in bringing in all crew, the company had to train local people to be professional crew and this worked best through learning by doing. The government also supported by paying talented students film schools in the US and the UK.

Today the company can offer a whole list of local film crew. For the production side there are: Location Scouts, Casting Directors, Line Producers, Production Managers, Location Managers, Production Coordinators, Set Coordinators, 1st and 2ND Assistant Directors, Script Continuity, Production Assistants, Set Runners, Hair Stylists, Make up Artists and Assistants, Manicurists, Wardrobe Stylists and Assistants, Pressers, Tailors, Caterers, Drivers, Security, Couriers,.
In the ART DEPARTMENT there are now available Art Directors, Props Masters, Props Builders, Buyers, Set Constructors, Set Dresser, Music Composers, and Musicians. And in d the technical Department: Cameraman/woman video, 2ND Assistant Cameraman/Clapper/Loader (35 mm), Sound Operator, Playback Operator, Gaffer, Spark, Best Boy Gaffer, Key Grip, Best Boy Grip, Generator Operator, Video Casting Operator. So the international clients only have to bring in the minimum from their creative department as well as the movie director, DOP and 1Ac.

As the company has expanded to productions also on other islands, and where there is not enough local crew available crew from Barbados and other, mainly the French islands are joining in.

There is a 2nd office now in St. Martin to better serve the Northern part of the Caribbean. One of the most successful companies providing locations and film, video and photo production service in the Caribbean region is “The Caribbean Production Service Company”, based in Barbados since 1998 and now operating in the entire Caribbean region. They trained numerous young local people in the nature of film making and are now benefiting in having the best choice in Caribbean crews in the region.

Personal Finance for Seniors Be Careful of Investment Scams

Studies have shown senior citizens are frequently the target of various investment scams, with many losing money and property to dishonest and predatory operators. The good news is that armed with the following information – seniors will know what to look for and can identify and avoid such scams.

Here is a list of the common scams that target the elderly, and how each operates.

Pyramid schemes
Investment seminars
“Compensation” Scams
Equipment leases
Gift annuities

Pyramid schemes

An old favorite for the scamsters, Pyramid schemes assure high returns to investors, but the only people who systematically get rich from these schemes are the promoters themselves. These investment opportunities generally promise large profits based on the investors’ ability to enlist other people to join the programs. Because the scheme uses the money from new investors to make payments to the old ones, some initial investors make money, but sooner or later, these schemes collapse and most of the investors lose all their money. Pyramid schemes often have no other source of revenue except for money put in by the new investors.

Investment seminars

Investment seminars do help to make money, but the ones who are consistently laughing their way to the bank are the advice peddlers. They are the ones making money from the admission charges, books, posters and audiotapes/ CDs sales. You should be very wary whenever you are offered any such get-rich-quick schemes.

“Compensation” Scams

These scams bring to mind the old adage, “Fool me once, shame on you; fool me twice, shame on me”. Investment scam victims often let the scamsters take them for a ride repeatedly. This is because the scammers promise to compensate the previous losses and bring in fresh gains. After losing some funds, seniors who have been duped once often go along with the new schemes with the hope of recouping their losses. Instead, they compound the damage and let the con artists take away more from their savings.

Equipment leases

It is true that most of the equipment lease deals are genuine, but there are quite a few tricksters operating who try to take advantage of the seniors by selling interests in ATMs, pay phones and Internet kiosks. What generally happens in such a scam is that companies sell equipment through intermediaries and then agree to lease back the equipment for a fee. Investors are promised huge profits with no risk. But the unrealistically high commissions and returns that they claim to pay are not feasible, and would doom any project.

Gift annuities

Gift annuities are basically cash/ property transfers to charitable organizations. A charitable gift annuity is just like a normal fixed annuity – except that a charity benefits from your investment. There is no problem with gift annuities per se, but many small organizations have jumped into the fray, promising high returns but giving only vague information about themselves. These are generally designed to relieve you of your funds or property, and it’s best to steer clear of such schemes.

While there is no shortage of con artists, most of them operate in very predictive ways, as outlined above. Seniors citizens can easily recognize these scams from the descriptions and methodologies mentioned here, and steer clear of the scammers before they are taken advantage of.
